Definition of Barnes V. Addy
((1873), L. R. 9 Ch. 244). ‘Held, that a stranger to a trust acting as agent of the trustees, may be liable as a constructive trustee if he assists with knowledge in a dishonest and fraudulent design on the part of the trustees. But an agent who assists in a breach of trust, e.g., as a solicitor, who draws up a document in contemplation of a breach of the trust, is not liable as a constructive trustee if he had no reason to suspect that any fraud waa contemplated
