Causing a Nuclear Explosion in Germany
Provisions relating to causing a nuclear explosion in the German Criminal Code [1]: This criminal issue is covered by Chapter Twenty-eight, under the heading “Offences Causing a Common Danger,” located in Section 307 Causing a nuclear explosion, which reads: (1) Whosoever undertakes to cause an explosion by the release of nuclear energy and thereby endangers the life or limb of another person or property of significant value belonging to another shall be liable to imprisonment of not less than five years. (2) Whosoever causes an explosion by the release of nuclear energy and thereby negligently endangers the life or limb of another person or property of significant value belonging to another shall be liable to imprisonment from one to ten years. (3) If by the offence the offender at least by gross negligence causes the death of another person the penalty shall in cases under subsection (1) above be imprisonment for life 1. or not less than ten years; 2. in cases under subsection (2) above be imprisonment of not less than five years. (4) Whosoever acts negligently in cases under subsection (2) above and negligently causes the danger shall be liable to imprisonment not exceeding three years or a fine.
