Definition of Chandelor V. Lop Us
((1604), Cro. Jac. 4). An innocent misrepresentation inducing a party to enter into a contract will not render the party making it liable in damages unless it is a warranty. The defendant sold to the plaintiff a stone which he affirmed to be a Bezoar stone, but which proved not to be so. Held, that no action lay against him, unless he either knew that it was not a Bezoar stone, or warranted it to be a Bezoar stone
