Driving While Under the Influence of Drink or Drugs in Germany

Provisions relating to driving while under the influence of drink or drugs in the German Criminal Code [1]: This criminal issue is covered by Chapter Twenty-eight, under the heading “Offences Causing a Common Danger,” located in Section 316 Driving while under the influence of drink or drugs, which reads: (1) Whosoever drives a vehicle in traffic (sections 315 to 315d) although due to consumption of alcoholic beverages or other intoxicants he is not in a condition to drive the vehicle safely shall be liable to imprisonment not exceeding one year or a fine unless the offence is punishable under section 315a or section 315c. (2) Whosoever commits the offence negligently shall also be liable under subsection (1) above.
