Definition of Fiction, Legal
Any assumption which conceals, or affects to conceal, the fact that a rule of law has undergone alteration, its letter remaining unchanged, its operation being modified (Maine). In English law fictions have played a considerable part. They may be said to be statement or suppositions which are known to be untrue, but which are not allowed to be denied, in order that some difficulty may be overcome, and substantial justice secured.
