Forgery in Europe

Definition of Forgery

At common law the fraudulent making or alteration of a writing to the prejudice of another man’s rights. By section 1, subsection 1, Forgery Act, 1913, ” The making of a false document in order that it may be used as genuine, and in the case of the seals and dies mentioned in this Act, the counterfeiting of a seal or die.”.
The forgery of a passport is a misdemeanour. (Criminal Justice Act, 1925, s. 36.)

Forgery in Germany

Provisions relating to forgery in the German Criminal Code [1]: This criminal issue is covered by Chapter Twenty-three, under the heading “Forgery,” located in Section 267 Forgery, which reads: (1) Whosoever for the purpose of deception in legal commerce produces a counterfeit document, falsifies a genuine document or uses a counterfeit or a falsified document, shall be liable to imprisonment of not more than five years or a fine. (2) The attempt shall be punishable. (3) In especially serious cases the penalty shall be imprisonment from six months to ten years. An especially serious case typically occurs if the offender acts on a commercial basis or as a member of a gang whose purpose is the continued commission of fraud or forgery; 1. causes 2. major financial loss; substantially endangers the security of legal commerce through a large number of counterfeit or falsified documents; or 3. 4. abuses his powers or his position as a public official. (4) Whosoever commits forgery on a commercial basis as a member of a gang whose purpose is the continued commission of offences under sections 263 to 264 or sections 267 to 269 shall be liable to imprisonment from one to ten years, in less serious cases to imprisonment from six months to five years.

Treasonous Forgery in Germany

Provisions relating to treasonous forgery in the German Criminal Code [1]: This criminal issue is covered by Chapter Two, under the heading “Treason and Endangering External National Security,” located in Section 100a Treasonous forgery, which reads: (1) Whosoever intentionally and knowingly allows falsified or altered objects, reports concerning them or untrue assertions of a factual nature to come to the attention of another or to become known to the public, which, if they were genuine or true, would be of significance for the external security of the Federal Republic of Germany or her relationships with a foreign power, in order to deceive a foreign power into believing them to be genuine objects or facts, and thereby causes the danger of serious prejudice to the external security of the Federal Republic of Germany or her relationship to a foreign power, shall be liable to imprisonment from six months to five years. (2) Whosoever produces such objects through falsification or alteration or procures them, in order to allow them in the manner indicated in subsection (1) above to come to the attention of another or to become known to the public in order to deceive a foreign power and thereby causes the danger of serious prejudice to the external security of the Federal Republic of Germany or her relationship to a foreign power, shall incur the same penalty. (3) The attempt shall be punishable. (4) In especially serious cases the penalty shall be imprisonment of not less than one year. An especially serious case typically occurs if the offender creates an especially serious prejudice to the external security of the Federal Republic of Germany or to her relations with a foreign power.
