Definition of Motion For Judgment
The mode of obtaining the judgment of the High Court in an action in all cases where no other mode of obtaining it is prescribed. (Order XL, r. 1.) At the trial of an action the Judge must now (Order XXXVI, r. 39) direct judgment to be entered as he thinks right, and no motion for judgment is necessary. If the defendant makes default in delivering his defence, the plaintiff must set down the action on motion for judgment, unless it is of such a nature that he may enter judgment for his claim at once (e.g., where it is for a debt, damages, recovery of land, or the like). (See Order XXVII.)
