Novatio in Europe
Definition of Novatio
The renewal or re-making of an existing obligation ; the transmutation of an obligation so that it ceases to exist and is renewed as a new obligation. The preceding obligation may have been contracted in any form and with any subject ; the new obligation must be verbis or literis and it must bind either civilly or naturally. (Roman Law.)
