Definition of Peachy V. Duke Of Somerset

((1824), 1 Stra. 447). The plaintiff was tenant of copyhold lands in a manor of which the defendant was lord. He committed acts of forfeiture by making leases contrary to the custom of the manor without licence, and by felling timber, etc., and he now brought this suit, offering to make compensation and praying relief from the forfeiture. Held, that the plaintiff was not entitled to relief ; and that the true ground of relief against penalties is from the original intent of the case, where the penalty is designed only to secure money, and the Court can give by way of recompense all that was expected or desired
