Causing a Common Danger by Poisoning in Germany

Provisions relating to causing a common danger by poisoning in the German Criminal Code [1]: This criminal issue is covered by Chapter Twenty-eight, under the heading “Offences Causing a Common Danger,” located in Section 314 Causing a common danger by poisoning, which reads: (1) Whosoever poisons or releases noxious substances into water in contained springs, wells, pipes or drinking 1. water storage facilities; or 2. objects intended for public sale or use, or sells, offers for sale or otherwise distributes poisoned objects or those into which noxious substances have been released within the meaning of No 2 above shall be liable to imprisonment from one to ten years. (2) Section 308 (2) to (4) shall apply mutatis mutandis.
