Special Case in Europe
Definition of Special Case
The parties to an action may, after the writ of summons has been issued, concur in stating the questions of law arising in the action in the form of a special case for the opinion of the Court without pleading. (Order XXXIV, r. 1.) The Court may direct questions of law in an action to be raised by special case (ibid. r. 2)
