Definition of Specific Performance

Where damages would be an inadequate compensation for the breach of an agreement, the contractor may be compelled to perform what he has agreed to do by a decree of specific performance, e.g., in contracts for the sale, purchase or lease of land, or for the recovery of unique chattels. Specific performance will not be decreed of contracts of personal service.
Actions for the specific performance of contracts relating to real estate are assigned to the Chancery Division by the Judicature Act, 1925, s. 56. See Lester v. Foxcroft; Seton v. Slade; Woollam v. Hearn; Cuddee v. Hutter
