((1789), 1 Yes. Jim. 22). Lady Strathmore, during her engagement of marriage with one Grey, conveyed and assigned her property to trustees for her separate use, with his approbation. Afterwards hearing that the defendant Bowes had fought a duel on her account, she married him instead of Grey. Bowes had no notice of the settlement. Held, that a conveyance by a wife, whatsoever may be the circumstances, and even the moment before the marriage, is prima facie good, and becomes bad only upon the imputation of fraud ; and that if a woman, in the course of a treaty of marriage with her, makes, without notice to the intended husband, a conveyance of any part of her property, it will be set aside because affected with that fraud ; but that this case was different, the settlement indeed being with the sanction of the then intended husband, and so the settlement here was established
