Immediate Order for Suspended Measure in Germany

Provisions relating to immediate order for suspended measure in the German Criminal Code [1]: This criminal issue is covered by Chapter Three Sanctionsunder the Sixth Title, Measures of Rehabilitation and Incapacitation,” located in Section 67b Immediate order for suspended measure, which reads: (1) If the court makes a mental hospital order or a custodial addiction treatment order it shall suspend the measure for an operational probationary period if special circumstances justify the expectation that the purpose of the measure may be achieved in this manner. A suspension shall not be ordered if the person is to serve a sentence of imprisonment imposed at the same time as the measure and which has not been suspended. (2) The order for suspension shall automatically lead to the person being subjected to supervision.
