Definition of Assault
The unlawful laying of hands on another person, or an attempt or offer to do a corporal hurt to another, coupled with an apparent present ability and intention to do the act. No mere words can in any case amount to an assault. (Stephen’s Digest of the Criminal Law.) Assault is both a tort and a crime punishable under the Offences against the Person Act, 1861. Common assaults may be dealt with by Courts of summary jurisdiction ; the more serious forms of assail It are indictable offences. See Battery; Cockcroft v. Smith
