Definition of Aylesford (Earl Of) V. Morris

((1873), L. R. 8 Ch. App. 484). The plaintiff, soon after he came of age, and whilst his father was living, borrowed from the defendant, who was a moneylender, sums amounting to about 7,000, for which he gave bills, which, with interest and discount, together exceeded 60 per cent. These bills were renewed, and after the death of plaintiff’s father, defendant sued plaintiff on the bills, and this suit was brought for an injunction to restrain the action on payment by the plaintiff of the sums advanced and interest at 5 per cent. Held, that the plaintiff was entitled to the relief sought, and that the fact of his being an actual tenant in tail in remainder, instead of being merely an expectant heir, made no difference
