Definition of Executor
An executor is the person to whom the execution of a will, that is, the duty of carrying its provisions into effect, is confided by the testator. The duties of an executor are to bury the deceased, to prove the will ; to collect the estate, and, if necessary, convert it into money ; to pay the debts in their proper order, to pay the legacies, and distribute the residue among the persons entitled. He may bring actions against persons who are indebted to the testator, or are in possession of property belonging to the estate. When several executors are appointed, and only some of them prove the will, these are called the proving or acting executors.
An executor is allowed a year to realise the testator’s estate before being bound to distribute it. See The Administration of Estates Act, 1925
