Definition of Garth V. Cotton
((1750), 1 Ves. 524, 546). Garth, the father of the plaintiff, was tenant of lands for ninety-nine years, if he should so long live, without impeachment of waste, except voluntary waste ; remainder to trustees during his life to preserve contingent remainders ; remainder to his first and other sons in tail ; remainder to defendant in fee. Garth (before the birth of a son) and the defendant came to an agreement under which they cut down timber and divided the profits between them. The plaintiff was afterwards born, and, having suffered a recovery, brought this bill against defendant to refund his share of the profits of the timber received by him. Held, that he was so entitled to recover from the defendant
