Definition of Kemble V. Farren
((1829), 6 Bing. 141). Money payable on breach of any of several stipulations of varying importance, or one of which is for the payment of a smaller sum, is a penalty The defendant agreed to act for the plaintiff at his theatre, the plaintiff to pay the defendant 3 6s. 8d. for every night the theatre should be open. The contract also provided that if either party committed any breach he should pay the other 1,000 as liquidated damages. Held, the sum was p penalty
