Definition of Mostyn V. Fabrigas

((1775), 1 Cowper, 161). An action will lie in an English Court for a tort committed abroad, provided the act is ” transitory ” and not ” local ” (i. e., not necessarily referred to some particular locality). This was an action of trespass in the Common Pleas by a native of Minorca against the Governor of the island in which the plaintiff alleged that the defendant made an assault upon him ” at Minorca, to wit at London, in the parish of St. Mary-le-Bow, in the Ward ‘of Cheap.” The defendant pleaded he was Governor of the island, and that the plaintiff was raising a sedition and mutiny, and that consequently he imprisoned him. Held, that an action lies against a Governor in the Courts of this country for injuries committed by him in the possession of which he is Governor
