Seton V. Slade in Europe
Definition of Seton V. Slade
((1602), 7 Ves. 265). The plaintiff had agreed to sell certain land to the defendant, and it was understood that he should make a good title in two months, and defendant gave him a notice that if he did not do so he should insist on the return of his deposit, with interest. The plaintiff, however, only delivered his abstract a few days before the expiration of the two months, which the defendant then received and kept without objection. Held, that the purchaser under the circumstances was not entitled to insist on time as of the essence of the contract, and so specific performance decreed
