Definition of Tenancy In Common

Where two or more persons are entitled to land in such a manner that they have an undivided possession but several freeholds : that is, no one of them is entitled to the exclusive possession of any part of the land, each being entitled to occupy the whole in common with the others ; and on the death of any one of them his share passes, not to the survivors, but to his heir or devisee, who then becomes tenant in common with the survivors. By the Law of Property Act, 1925, s. 34, no undivided share in land is capable of being created, except as equitable interests under a settlement, or as that of a joint tenant upon the statutory trusts for sale
