Definition of Benefit Of Clergy

Exemption of the persons of clergymen from criminal process. An accused clerk was handed over by the secular Court to the Bishop to be tried in the ecclesiastical Courts. The privilege was extended to all able to read, but many statutes were passed making felonies punishable without benefit of clergy. Women originally could not claim the benefit, but it was later extended to them. Benefit of clergy could not be claimed in treason. It was abolished in 1827
