Definition of Cheque
A cheque is a bill of exchange (q.v.) drawn on a banker, payable on demand (Bills of Exchange Act, 1882, s. 73). The person making the cheque is called the drawer, and the person to whom it is payable is called the payee. When the cheque bears across its face the words ” and Company,” or any abbreviation thereof, between two parallel transverse lines, it is said to be crossed generally, and when it bears across its face the name of a banker, it is said to be crossed specially. (Section 76.) A generally crossed cheque can be paid only through a bank, and a specially crossed cheque only through the bank specified. A holder of a cheque crossed ” not negotiable ” cannot give a transferee a better title than he himself has. (Section 81.) See London Joint Stock Bank v. Mcwmillan
