Definition of Clark V. Molyneux
((1877), L. R. 3 Q. B. D. 237). Held, that in an action for libel where qualified privilege is proved, the burden of proof of actual malice lies on the plaintiff. If the defendant believed his defamatory statement to be true, the fact that the belief is unreasonable will not defeat his privilege. Clausum fregit. Breach of Close (q.v.)
