Estoppel in Europe
Definition of Estoppel
The rule of evidence or doctrine of law which precludes a person from denying the truth of some statement formerly made by him, or the existence of facts which he has by words or conduct led others to believe in
(1) Estoppel by record. A person is not permitted to dispute the fa ts upon which a judgment against him is based
(2) Estoppel In deed. A person cannot dispute his own deed ; he cannot deny the truth of recitals contained in it
(3) Estoppel in pais. Estoppel by conduct, e.g.,’ a, tenant, having arcepted a lease, cannot dispute his lessor’s title
(4) Equitable estoppel. If a person by representation induces another to change his position, he cannot afterwards deny the truth of his representation
