Definition of Issue
(1) The issue of a person consists of his children, grandchildren, and all other lineal descendants. (2) ” Issues ” is the technical name for the profits of land taken in execution under a writ of distringas (q.v.). (3) When the parties to an action have answered one another’s pleadings in such a manner that they have arrived at some material point or matter affirmed on one side and denied on the other, the parties are said to be ” at issue ” ; the last pleading is called a joinder in issue, and the question thus raised is the issue in the action.
A ” general issue ” was a plea used where the defendant wished to deny all the allegations in the declaration or the principal fact on which it was founded ; such was a plea of not guilty to an indictment
