Definition of Per Stirpes
By stock or branches. Distribution of the property of an intestate is per stirpes if it is divided amongst those entitled to it according to the number of stocks of descent ; that is, if it is divided equally amongst the surviving children of an intestate individually, and the descendants of deceased children collectively, so that the descendants of a deceased child take that child’s share between them.
