Re-hearing in Europe
Definition of Re-hearing
The re-arguing of a cause or matter which has been already adjudicated upon. Every appeal to the Court of Appeal is by way of re-hearing, and hence the Court may receive fresh evidence and review the whole case. (Order LVIII, r. 1.) See Appeal.
The Criminal Appeal Act, 1907, s. 9, empowers the Court of Criminal Appeal to treat an appeal as a re-hearing to such extent as they think fit ; but evidence that was not given at the trial is not commonly received
