Definition of Tulk V. Moxhay, Rule In
(2 Ph. 774). A restrictive covenant entered into by an owner or lessee of land is enforceable in equity against any subsequent owner, tenant, or occupier, except a purchaser for value, who obtains the legal estate in the land without notice of the covenant. The covenant must be negative, i. e., not involving expenditure, and must simply restrict the user of the land, and it must bind land of the covenantor for the benefit of the land of the covenantee
