Vint V. Padget in Europe
Definition of Vint V. Padget
((1858), 2 De G. & J. 611). Two estates were mortgaged to distinct mortgagees. The mortgagor then made a second mortgage of the two estates to another person. Afterwards the two first mortgages were transferred to one person, with notice of the second mortgage. The transferee then brought a foreclosure suit against the second mortgagee, requiring him to pay off both mortgages. Held, that the transferee was entitled to unite the two mortgages, and that the second mortgagee was not entitled to redeem one without the other
