Definition of Marriot V. Hampton
((1797), 7 T. R 269). Where money has been paid by the plaintiff to the defendant under the compulsion of law, which is afterwards discovered not to have been due, the plaintiff cannot recover it back in an action for money had and received.
The plaintiff having lost a receipt for a debt which he had paid, was sued for the debt by the defendant and judgment, which was satisfied, was given against him. Having found the receipt, he sought to recover the money. Held, he was estopped by the judgment
