Definition of Riot
There are five necessary elements of a riot: (1) Number of persons, three at least ; (2) common purpose ; (3) execution or inception of the common purpose ; (4) an intent to help one another by force if necessary against any person who may oppose them in the execution of their common purpose ; (5) force or violence not merely used im demolishing, but displayed in such a manner as to alarm at least one person of reasonable firmness and courage (per Phillimore, J., Field v. Receiver of Metropolitan Police, [1907] 2 K. B. 859).
Where twelve or more persons are committing a riot, it is the duty, under the Riot Act, (1 Geo. 1, st. 2, c. 5), of the mayor, sheriff, and certain other officers to make a proclamation in the King’s name, commanding them to disperse ; and every person who obstructs the making of the proclamation, or continues to riot for one hour afterwards, is guilty of felony
Riotous damage or demolition of property is an offence under the Malicious Damage Act, 1861
